DHS memo on Schedule A filings after PERM

This June 15, 2005 USCIS field memo sets specific requirements for Schedule A I-140s filed on or after March 28, 2005, under DOL’s PERM regulations. The memo states that a copy of the State Workforce Agency’s (SWA) Prevailing Wage Determination (PWD) used to complete the ETA 9089 must be included with the documentation supporting such I-140s. Although it was clear that a SWA PWD had to be obtained in order to complete the ETA 9089, prior to this memo it had not been specified that a petitioner must include a copy of the SWA PWD with the I-140 petition.
