Adviser's Manual Online Update History 2007

Changes to laws and policies, as well as new insights in areas of practice, may lead to revision of the Adviser’s Manual Online content. Content revision is a process, and often requires research, analysis, clarification from the government, and consultation with content experts, before changes to the Adviser's Manual Online are made.

When we complete and upload content changes to the Manual, we e-mail notification to Principal License Holders and their designated Additional Users, and post hyperlinks to the changed sections in the Chapter One landing page that appears after launching the Manual. Here is a list of the most recent changes.

Added practice notes on new requirement for I-129 petition approval to be verified in consulates' CCD PIMS report before an H or O visa is issued. 12/17/2007
Effective January 1, 2008, the Machine Readable Visa (MRV) fee was raised. 12/17/2007
Updated practice notes on F and M schools reporting material changes to curriculum to SEVP. 12/17/2007
Effective November, 2007, for non-EAD based F-1 student employment SSA will not process an application for a SSN more than 30 days in advance of the scheduled employment start date. In the case of EAD-based F-1 or M-1 employment, the employment start date on the EAD must already have been reached before SSA will process a SSN. 12/11/2007
Effective December 3, 2007, new fees for J Exchange Visitor Program services go into effect, including a new fee for program redesignation. The new fees must be paid through Pay.gov. 11/30/2007
Starting November 26, 2007, employers must begin using the latest Form I-9, which contains a revised List A (documents that are acceptable to show both identity and employment eligibility) that now conforms to DHS regulations. 11/30/2007
A final rule effective November 1, 2007, removes a prior requirement that H and L nonimmigrants returning to the United States following a trip abroad while their adjustment of status applications were pending present an I-485 receipt notice to avoid having their applications deemed abandoned.

Added practice note on the topic of whether a student can continue to work at the transfer-out school until the transfer release date even if he or she finished the program of study. The note discusses conflicting DHS guidance on the topic. 11/30/2007
Updated practice note discussing new DHS rules regarding "constructive knowledge" and employer responses to "no-match" letters. A federal court issued a preliminary injunction that stops DHS and SSA from implementing those rules. 11/30/2007
Removed outdated information on examination requirements for ECFMG sponsorship in the Alien Physician category. 11/30/2007
Added a Practice Note regarding SEVIS 5.7's date limitations in the Registration function. Note especially that the Next Session Start Date may not be greater than the Program End Date. 09/14/2007
