USCIS memo clarifies impact of failure to comply with NSEERS

An October 14, 2004 USCIS interoffice memo states that an alien’s willful and unexcused failure to comply with NSEERS Special Registration requirements would not justify the denial of a visa petition filed on the alien’s behalf; however, failure to comply with NSEERS may support the denial of a benefit actually granting status.
