DHS Removes I-485 Receipt Requirement for H and L Nonimmigrants Who Travel With Pending Adjustment of Status

72 Fed. Reg. 61791 (November 1, 2007)

Effective November 1, 2007, the Department of Homeland Security (DHS) removed the requirement that certain H and L nonimmigrants returning to the United States following a trip abroad while their adjustment of status applications are pending must present an I-485 receipt notice to avoid having such applications deemed abandoned. Showing the I-485 receipt notice is no longer required. Other conditions of admissibility for such nonimmigrants remain unchanged.
