Leocal v. Ashcroft Supreme Court Decision

In this case, the U.S. Supreme Court held that State DUI (Driving under the influence) offenses that do not have a mens rea (criminal intent) component or require only a showing of negligence in the operation of a vehicle, are not crimes of violence under 18 U.S.C. Sec. 16, and thus are not considered as an "aggravated felony" ground for deportation under the Immigration and Nationality Act. AMDOC#: 200411006
