On July 2, 2007, USCIS and DOS had informed the public that the July 2007 Visa Bulletin that originally showed most EB categories as "current" were in fact unavailable. Public outcry ensued. Congressional scrutiny was applied. Litigation was threatened.
In response, on July 17, 2007, USCIS, in coordination with DOS, stated that July 2007 EB numbers are available again, with a filing window extended until August 17, 2007.
The July 17 retraction states that the information in the July 2007 Visa Bulletin as originally published on June 12, 2007 should now be used for determining immigrant visa number availability and filing eligibility, until August 17, 2007.
The August 2007 Visa Bulletin confirms this at item D, which states: "JULY EMPLOYMENT-BASED VISA AVAILABILITY After consulting with Citizenship and Immigration Services, the Visa Office advises readers that Visa Bulletin #107 (dated June 12) should be relied upon as the current July Visa Bulletin for purposes of determining Employment visa number availability, and that Visa Bulletin #108 (dated July 2) is hereby withdrawn."
