A USCIS final rule, published on April 15, 2011 and effective May 15, 2011, adopted this interim final rule without change.

A federal register notice published on February 3, 2009 delayed the effective date of this interim final for 60 days, until April 3, 2009. The public comment period was reopened for a 30-day period, until March 4, 2009.

This USCIS interim final rule amends the types of documents acceptable in the I-9 identity and employment authorization verification process, and requires all documents to be unexpired in order to be acceptable for I-9 purposes. In addition, employers must use the correct version of Form I-9 to verify the employment eligibility of new hires. Information on acceptable versions of Form I-9 can be found on the USCIS Web site at www.uscis.gov/i-9.
Additional guidance from a December 12, 2008 USCIS Update:
"The rule eliminates Forms I-688, I-688A, and I-688B (Temporary Resident Card and older versions of the Employment Authorization Card/Document) from List A. USCIS no longer issues these cards, and all that were in circulation have expired. The rule also adds to List A of the Form I-9 foreign passports containing specially- marked machine-readable visas and documentation for certain citizens of the Federated States of Micronesia (FSM) and the Republic of the Marshall Islands (RMI). The rule makes other, technical changes to update the list of acceptable documents. The revised Form I-9 includes additional changes, such as revisions to the employee attestation section, and the addition of the new U.S. Passport Card to List A."
