On May 6, 2002, the Department of Labor published a proposed rule that would implement the long-anticipated “PERM” program that would change the way labor certification applications are filed and processed. The rule would also amend the regulations governing an employer’s wage obligation under the H-1B program by eliminating the 5% rule.
