This DOS field cable infers that an F-1 student who has timely applied for Optional Practical Training (OPT) following completion of his or her course of study may travel outside the United States while the OPT application is pending. The cable instructs consular officers that for aliens applying for F-1 visas, they may accept either an EAD or, if the OPT application were still pending, the I-765 receipt notice (Form I-765), as proof of eligibility for the visa. NAFSA has asked USCIS to communicate similar guidance to adjudicators, and CBP to communicate this guidance to inspectors at ports of entry. Until all DHS immigration bureaus are in agreement concerning this policy, readmissibility or eligibility for benefits will continue to be at issue. AMDOC#: 200405007
