AAO Approves E12 Case For Outstanding Researcher

In a December 23, 2011 decision, the Administrative Appeals Office (AAO) applied Kazarian standards to find in favor of a petitioning employer seeking to classify an employee as an employment-based first preference outstanding researcher under INA section 203(b)(1)(B) [employment-based first preference outstanding Professors or Researchers, often referenced as E 1 2].

Following Kazarian, AAO first found that the petitioner had submitted the minimum number of required types of evidence, and then evaluated the entirety of the evidence in a “final merits determination,” finding that the nature of the evidence submitted “does set the beneficiary apart in the academic community through eminence and distinction based on international recognition.”
