On March 7, 2002, DOS amended 22 C.F.R. 112(d), the provision that allows for automatic revalidation of expired visas for nonimmigrant aliens returning from short visits to other North American countries or adjacent islands. [67 Fed.Reg. 10323 (March 7, 2002)]
Under the new rule, two groups of aliens are now ineligible for the automatic revalidation benefit:
1) Any alien who applies for a new visa during such visits; and
2) Aliens who are nationals of countries identified as state sponsors of terrorism.
