DOS deleted 22 C.F.R. section 41.105(b) effective January 1, 2008.

That section called for fingerprint and name checks of non-immigrant visa applicants only in certain circumstances, and provided that a fee for fingerprint checks would only be charged when a name check indicated the possibility of a criminal history. Under another rule also effective January 1, 2008, however, DOS began conducting and charging for fingerprint checks and name checks on all visa applicants who do not fall within certain exceptions. 22 C.F.R. section 41.105(b) was removed to make the regulations consistent.
