An August 8, 2004 USCIS field memo provided guidance to Service Centers concerning the procedures for handling H-1B petitions for F and J nonimmigrants affected by the Federal Register cap-gap notice of July 23, 2004 [69 Fed. Reg. 44044]. The memo provide guidance on several issues, including eligibility, filing for change of status while in the 60 (F-1) or 30-day (J-1) grace period, concurrent change of status requests, and motions to reopen.
