A U.S. Citizenship and Immigration Services (USCIS) final rule effective November 12, 2004 amends DHS regulations by adding Actuaries and Plant Pathologists to Appendix 1603.D.1 of the North American Free Trade Agreement (NAFTA). The rule’s supplementary information also confirms a March 10, 2004 change to the regulations that removed the requirement that NAFTA beneficiaries present U.S. licensure as a condition of entry under NAFTA, if the state where employment will occur requires licensure in order to begin employment. USCIS stated that although U.S. licensure may be a requirement to begin employment in the U.S. once a TN nonimmigrant arrives, it is not a requirement of entry under NAFTA. [69 Fed.
