A July 30, 2004 interim rule amends 8 CFR 274a.12(a) and (c) to eliminate provisions that provide a maximum validity period for certain EADs, allowing USCIS to set EAD validity periods that reflect the underlying immigration status. The rule also amends 8 CFR 274a.12(a)(5) to reflect that BCIS will issue initial EADs to aliens granted asylum by the EOIR with validity periods of up to five years, unless otherwise appropriate.
