NAFSA Signs Joint Statement in Support of Afghan Scholars and Students

On February 4, 2022, NAFSA joined Scholars at Risk and 47 other higher education associations in a letter urging the Biden administration to take "immediate action to enable the safe and speedy relocation of Afghanistan’s students and scholars in the United States" The letter also includes several specific policy recommendations to support Afghan students and scholars.

Notice of Proposed Class Action Settlement for Enrollees at the University of Northern New Jersey (UNNJ)

The Department of State reports: "Plaintiffs in this class action are current and former F-1 nonimmigrants who previously enrolled at the University of Northern New Jersey (UNNJ), an undercover school set up by the Department of Homeland Security. On November 22, 2021, the Parties reached a Preliminary Settlement Agreement. On January 10, 2022, the Court granted the Parties’ Joint Motion for Preliminary Class Certification and Preliminary Settlement Approval. In its order, the Court certified a class consisting of “[a]ny noncitizen who, for any period of time, enrolled in the University of Northern New Jersey.” The Preliminary Settlement Agreement, if approved, will affect you if you are a member of this class. If you are a member of this class, you should read this “Notice of Proposed Class Actions Settlement” (“Notice”) carefully as it explains certain time-limited opportunities you may qualify to pursue. This Notice also explains certain obligations you will be required to comply with if the Preliminary Settlement Agreement is approved. To see the Notice and learn how to obtain a copy of the Preliminary Settlement Agreement, please click here. If after reviewing the Settlement Agreement you still have questions, you can contact Plaintiffs’ Counsel (see contact information in the notice)." Vaccine Requirement at Land or Ferry Ports of Entry Now Fully in Effect

In a pair of Federal Register notices published on January 24, 2022 but effective January 22, 2022, CBP announced the end of the prior "essential travel" restrictions on entry through a land or ferry port of entry at the Canadian and Mexican borders, replacing those restrictions with a vaccine requirement virtually identical to the one that governs entry through air ports of entry.

DOS Designates Third-Country Posts for Processing F, M, J Visas for Russian Residents

January 24, 2022
On January 21, 2021, the Department of State announced that it had designated consular offices at "Mission Kazakhstan and U.S. embassies Belgrade and Yerevan" to accept applications from residents of Russia applying for F, M, and J visas, "due to the severely limited consular operations in Moscow." DOS also said "This designation does not prevent Russia-based F, M, and J applicants from applying at another post where they are physically present."

DHS Adds 22 Fields to STEM Designated Degree Program List

DHS announced that effective January 21, 2022, it will add "22 qualifying fields of study and a corresponding Department of Education Classification of Instructional Programs (CIP) code for each" to the DHS STEM OPT Designated Degree Program List that governs eligibility for a 24-month STEM OPT extension.

Comments on Revisions to Form I-129H1 Due

January 19, 2022
USCIS is giving the public until February 18, 2022 to comment on revised I-129H1 form and instructions. USCIS still plans to separate Form I-129, Petition for Nonimmigrant Worker, into several individual forms, including stand-alone I-129 petitions for H-1B, TN, and O classifications. Comments on the original changes were due October 18, 2021. The new comment period is for comments on revisions to the I-129H form and instructions in response to comments from the prior notice, and the removal of elements that would have been required by the H-1B selection rule that was withdrawn on December 22, 2021.
